潛水器採捕水產動植物管制措施總說明
交通部於九十三年二月十一日依發展觀光條例第三十六條訂定「水域 遊憩活動管理辦法」，該辦法第十七條即已規定「潛水活動不得攜帶魚槍 射魚及採捕海域生物」，惟該條已於一百零五年三月十八日修正刪除，爰 目前倘民眾潛水採捕水產動植物，恐無相關法規之適用。

八、有關射魚、採捕海域生物行為回歸漁業法、野生動物保育法、國家 公園法、發展觀光條例等自然資源或漁業資源管理法規予以必要之 - 2 - 管理，本辦法係以水域遊憩活動管理為主，為避免與其他法規競合， 刪除修正條文第十八條第三款。
